An Ontario, Canada, contractor taking on a renovation project at an industrial plant in Kitchener, Ontario is facing a $55,000 fine for an incident that left two workers with fall-related injuries in July 2018.

Ball Construction Inc. pleaded guilty in court March 3 to falling short of provincial safety regulations, section 26.1(1) of Ontario Regulation 213/91.

The incident involved two workers employed by a subcontractor, the Ministry of Labour, Training and Skills Development said. In order to make space to operate an elevated work platform, the two workers were moving wooden wall sections, which, unknown to them, had been laid over an abandoned press pit.

Previous crews had circled the pit with caution tape and pylons, but stopped short of placing guardrails, as required by safety requirements. While working together to pick up the wall sections, both workers fell into the approximately three-meter-deep pit and suffered injuries.

Along with the $55,000 fine, Ball will be required to pay a 25 percent surcharge into the province’s fund to assist victims of crime.
